الظاهرية والمقاصد

Abstract

هذه دراسة حول أحد أهم المذاهب الفقهية وهو المذهب الظاهري، في تعامله مع مقاصد الشريعة الإسلامية، من حيث القبول والرد، كل ذلك من خلال كتاب الإحكام في أصول الأحكام لأحد أهم الشخصيات عبر التاريخ الإسلامي وهو ابن حزم الأندلسي، الذي نصر هذا المذهب ودافع عنه ووضع أصوله وقواعده، وقد تناولت هذه الدراسة جانبين، الجانب النظري: وتضمن موقف الظاهرية وابن حزم على وجه الخصوص من مباحث التعليل وإسقاطها على مقاصد الشريعة باعتبار أنه الأساس الذي تبنى عليه، أما الجانب التطبيقي: فقد تضمن نماذج من تعامل ابن حزم مع مقاصد الشريعة الإسلامية من حيث الإعمال والإهمال.

This work studies one of the Islamic jurisprudence schools, called Adhahiri school, it sheds light on how it deals with Maqasids (the objectives of Islamic law) in terms of considering or neglecting them. It is based on the book untitled “Al-Ihkam Fi Usul al-Ahkam” (A deep reflection on the principles of Islamic rulings) written by Ibn Hazm Al-Andalusi, the founding father of this school and its strong defender. The study consists of two parts: the theoretical one focuses on the position taken by the followers of this school, mainly Ibn-Hazm’s, in regards to the issues of reasoning when Maqasids, their principle pillar, are considered; the practical part, however, includes some examples showing how Ibn-Hazm dealt with the objectives of Islamic laws, considering and neglecting them.
