Abstract

الموظف العام هو العنصر الأساسي في الدولة، و المحرِّك الرئيسي للنشاط الإداري، وبحكم العلاقة التي تربط بين الموظف والإدارة، تتقرر له حقوق وتفرض عليه واجبات، والتي من خلال ممارستها قد يقع في أخطاء قد تلحق أضرارا بالغير، مما يرتب عليه مسؤولية. أما المسؤولية الشخصية هي التزام الموظف في حدود القانون، بتحمله نتائج وعواقب التقصير الصادر عنه، أو هي محاسبته و مؤاخذته عن فعل أو سلوك معينٍ مخالفٍ للقانون. إن قيام المسؤولية الشخصية للموظف يكون على أساس الخطأ الشخصي، الذي يصدر عن الموظف، وفي هذا الصدد قد تطال الموظف ثلاث أنواع من المسؤوليات مدنية، جنائية، تأديبية، تبعا لنوع الخطأ المرتكب. فيترتب على قيام المسؤولية الشخصية للموظف العام، أثرا يختلف باختلاف نوع المسؤولية القائمة
