المشاركة العمالية في تسيير الهيئة المستخدمة في التشريع الجزائري

Abstract

من خلال ما سبق وبالعودة إلي الإصلاحات التي جاء بها قانون90/11 المتعلق بعلاقة العمل فان المشاركة العمالية في تسيير المؤسسة المستخدمة تتم علي مستوايين : يتمثل الأول في المشاركة الفعلية في صنع القرارات والإشراف الفعلي علي التسيير الاقتصادي والمالي والتنظيمي للمؤسسة من خلال ممثلي العمال في مجلس الإدارة . بينما الثاني يتمثل في المشاركة الاستشارية والإعلامية التي يمارسها العمال من خلال لجنة المشاركة علي مستوي المؤسسة . وما يلاحظ حول هده المشاركة هو ضعف التمثيل العمالي في مجلس الإدارة الذي يكاد لا يظهر .إضافة إلي الصلاحيات الأساسية الاسترتيجية التي تحتفظ بها جمعية المساهمين والتي لا يمثل العمال فيها. كما يلاحظ من خلال تشكيلة لجنة المشاركة ان المشرع الجزائري كان مبالغا في تحديد نصاب عشرون (20) عاملا لانتخاب مندوبي المستخدمين مقارنة بالمشرع الفرنسي مثلا الدي حدد احدى عشر(11) عاملا.لانه كلما كان النصاب منخفضا كان الانضمام مستبعدا.

Through what has been referred to, and with returning back to the reforms provided by Law 90/11 of work relation, the participation of workers in the management of the ‘’usingenterprise’’ is done at two levels: The first is to participate actively in decision-making and to effectively supervise the economic, financial and organizational management of the enterprise through the workers' representatives in the board of directors.While the second is in the consultative and media participation performed by the workers through the committee of participation at the level of the enterprise. We notice about this participation that the representation of workers in the Board of Directorsis very low that is hardly noticeable which is hardly visible. In addition to the basic strategic powers kept by the shareholders' association in which the workers are not represented. It is also noted through the composition of the participation committee that the Algerian legislator,compared to the French legislatorfor example, exaggerated in determining the quorum of twenty (20) workers to elect delegates of the workers(eleven (11)in the france), because the lower the quorum is,the lower the possibility of joining gets.
